Решения НАЭН/ОЭРН от 23.10.2025: участие и статусы компетентных лиц

В связи с возникшим острым конфликтом интересов и публичной активностью, вводящей в заблуждение относительно статуса НАЭН как единственной NRO РФ и национального стандарта («Кодекс НАЭН»), что отражено в направленных НАЭН материалах в СК РФ, Минюст и ФАС, а также во избежание причинения репутационного вреда и дезорганизации порядка публичной отчётности, ПРИКАЗЫВАЮ:

(1) Прекратить с «23» октября 2025 г. участие во всех органах и совместных комиссиях НАЭН/ОЭРН (включая комитеты, рабочие группы и иные коллегиальные органы):

• Свинтицкого Игоря Львовича;
• Эпштейна Игоря Владимировича.

(2) Временно приостановить на период проверки (до решения Дисциплинарной комиссии НАЭН) участие в органах/совместных комиссиях НАЭН/ОЭРН следующих лиц:

• Малухин Григорий Николаевич;
• Ильин Олег Витальевич;
• Лазарев Александр Борисович;
• Лесков Михаил Иванович;
• Кушнарев Пётр Иванович;
• Тарасов Александр Сергеевич;
• Машковцев Григорий Анатольевич;
• Писарницкий Александр Давыдович;
• Якубчук Александр Сергеевич.

Указанным лицам представить письменные объяснения в Дисциплинарную комиссию НАЭН до «01» декабря 2025 г.

(3) Статусы/сертификаты и право подписи

3.1. Аннулировать (revoke) действие выданных НАЭН/ОЭРН (и признанными НАЭН RPO) статусов компетентного лица, сертификатов/удостоверений, реестровых записей и прав подписи публичной отчётности по Кодексу НАЭН у следующих лиц — с даты подписания настоящего приказа:

• Свинтицкий Игорь Львович;
• Эпштейн Игорь Владимирович.

3.2. Приостановить (suspend) действие выданных НАЭН/ОЭРН (и признанными НАЭН RPO) статусов компетентного лица, сертификатов/удостоверений, реестровых записей и прав подписи публичной отчётности по Кодексу НАЭН у лиц, указанных в п. (2), на период проверки (до итогового решения ДК НАЭН).

3.3. Обязать лиц, указанных в п. 3.2, направить в Дисциплинарную комиссию НАЭН (info@naen.ru) письменные объяснения и подтверждающие материалы не позднее «01» декабря 2025 г. (включительно).

3.4. В случае непредставления письменных объяснений в срок, указанных в п. 3.2 лиц считать их статусы/сертификаты и права подписи аннулированными (revoke) с «02» декабря 2025 г. с внесением соответствующих записей в реестры и публикацией отметок revoked на сайте НАЭН, без издания дополнительного приказа (основание — настоящий приказ и протокол ДК по факту неисполнения).

3.5. Понимание терминов. Под «статусом/сертификатом» в целях настоящего приказа понимаются: (i) запись в Реестре компетентных лиц НАЭН/ОЭРН (исторический компонент при НАЭН), (ii) удостоверение/сертификат компетентного лица, (iii) иные выданные НАЭН допуски/рейтинги на право подписи публичной отчётности по Кодексу НАЭН. На период приостановления (suspend) право подписи не действует.

(4) Секретариату НАЭН:

4.1. Немедленно обновить составы органов на сайте, обновить статусы в реестрах (пометки: suspended/removed/revoked), снять упоминания в перечнях комиссий;

4.2. Разослать уведомления вовлечённым площадкам и партнёрам (CRIRSCO — preservation notice по линии Russia/NRO; профильные регуляторы/биржа/ФБУ «ГКЗ» — о действии Кодекса НАЭН и статусах компетентных лиц только в рамках НАЭН).

(5) Назначить заседание Дисциплинарной комиссии НАЭН на «13» ноября 2025 г.; утвердить повестку (конфликт интересов, вводящая в заблуждение публичная активность, использование охраняемых обозначений/корпуса текста, риск дезориентации рынка). Решения ДК могут включать: предупреждение, приостановку, исключение из органов/реестров, аннулирование статуса/сертификата, предписание об опровержении/исправлении материалов.

(6) Контроль исполнения возложить на Решмакову Н.А. Настоящий приказ подлежит опубликованию на сайте НАЭН.

Основания:

• Следственный комитет РФ: сообщение о преступлении в адрес Председателя СК РФ, генерала юстиции РФ А.И. Бастрыкина; входящий № ЮЛСК‑16284‑25 от 22.10.2025.
• Федеральная антимонопольная служба России: заявление о недобросовестной конкуренции Руководителю ФАС России М.А. Шаскольскому; входящий канцелярии № 187369/25 от 28.10.2025 (по материалам, поданным НАЭН ранее указанной даты).
• Министерство юстиции РФ (ГУ по г. Москве): заявление о приостановлении деятельности и ликвидации МОО «ОЭРН» Начальнику ГУ Минюста по г. Москве К.А. Балашову о применении мер по ст. 42 и 44 Закона № 82‑ФЗ.

In view of the emergence of an acute conflict of interest and public activity that misleads stakeholders regarding NAEN’s status as the sole NRO of the Russian Federation and regarding the national reporting standard (“NAEN Code”), as reflected in the materials submitted by NAEN to the Investigative Committee of the Russian Federation, the Ministry of Justice and the Federal Antimonopoly Service, and in order to prevent reputational harm and disorder of the public reporting framework, I HEREBY ORDER:

(1) To terminate, effective 23 October 2025, participation in all NAEN/OERN bodies and joint commissions (including committees, working groups and other collegial bodies) of:

• Igor Lvovich Svintitsky;
• Igor Vladimirovich Epshtein.

(2) To temporarily suspend, for the duration of the review (until a decision of the NAEN Disciplinary Commission), participation in NAEN bodies/joint commissions of the following persons:

• Grigory Nikolayevich Malukhin;
• Oleg Vitalyevich Ilyin;
• Alexander Borisovich Lazarev;
• Mikhail Ivanovich Leskov;
• Pyotr Ivanovich Kushnarev;
• Alexander Sergeyevich Tarasov;
• Grigory Anatolyevich Mashkovtsev;
• Alexander Davydovich Pisarnitsky;
• Alexander Sergeyevich Yakubchuk.

The above persons shall submit written explanations to the NAEN Disciplinary Commission no later than 01 December 2025.

(3) Statuses/certificates and signing rights

3.1. Revoke the validity of NAEN/OERN‑issued (and NAEN‑recognized RPO) Competent Person statuses, certificates/IDs, register entries and signing rights for public reporting under the NAEN Code with respect to the following persons — as of the date of this Order:

• Igor Lvovich Svintitsky;
• Igor Vladimirovich Epshtein.

3.2. Suspend the validity of NAEN/OERN‑issued (and NAEN‑recognized RPO) Competent Person statuses, certificates/IDs, register entries and signing rights for public reporting under the NAEN Code for the persons listed in item (2) for the period of the review (until the final decision of the NAEN Disciplinary Commission).

3.3. Require the persons listed in item 3.2 to submit to the NAEN Disciplinary Commission (info@naen.ru) written explanations and supporting materials no later than 01 December 2025 (inclusive).

3.4. If written explanations are not submitted by the deadline, the persons listed in item 3.2 shall be deemed to have their statuses/certificates and signing rights revoked as of 02 December 2025, with corresponding entries made in the registers and “revoked” labels posted on the NAEN website, without issuing a separate order (basis: this Order and the Disciplinary Commission minutes noting non‑compliance).

3.5. Definitions. For the purposes of this Order, “status/certificate” means: (i) an entry in the NAEN/OERN Competent Persons Register (the historical component under NAEN), (ii) a Competent Person ID/certificate, and (iii) any other NAEN‑issued permits/ratings granting the right to sign public reports under the NAEN Code. During suspension, signing rights do not apply.

(4) NAEN Secretariat shall:

4.1. Immediately update the compositions of bodies on the website, update statuses in the registers (marks: suspended/removed/revoked), and remove references in commission rosters;

4.2. Send notifications to the relevant platforms and partners (CRIRSCO — preservation notice on the Russia/NRO track; sector regulators/the Exchange/FBU “GKZ” (State Commission on Mineral Reserves) — that the NAEN Code is in force and Competent Persons’ statuses are valid only within NAEN).

(5) Schedule a meeting of the NAEN Disciplinary Commission for 13 November 2025; approve the agenda (conflict of interest; misleading public activity; use of protected designations/text corpus; risk of market disorientation). The Disciplinary Commission’s measures may include: warning, suspension, removal from bodies/registers, revocation of status/certificate, and an order to correct/recant misleading materials.

(6) Assign implementation control to N.A. Reshmakova. This Order is subject to publication on the NAEN website.

Grounds:

• Investigative Committee of the Russian Federation: report of an offence addressed to the Chairman of the Investigative Committee, Colonel‑General of Justice A.I. Bastrykin; incoming No. YULSK‑16284‑25 dated 22.10.2025.
• Federal Antimonopoly Service (FAS) of Russia: application on unfair competition addressed to the Head of FAS Russia M.A. Shaskolsky; incoming registry No. 187369/25 dated 28.10.2025 (based on materials previously submitted by NAEN).
• Ministry of Justice of the RF (Main Directorate for Moscow): application for suspension of activity and liquidation of the Interregional Public Organization “OERN” addressed to the Head of the Moscow Main Directorate K.A. Balashov, seeking measures under Articles 42 and 44 of Federal Law No. 82‑FZ.
